If you are accessing or using this site in your capacity as an employee or other representative of an Employer, you agree to these Terms and Conditions on behalf of yourself and your Employer.

This site is offered and available to Employers operating in the State of Iowa and/or the State of Illinois and to individual users who are 13 years of age or older and reside in the United States. By using this website, you represent and warrant that you meet these eligibility requirements and, if under the age of 18, have submitted a valid Consent Form permitting your use of this site.

If you do not meet these requirements or do not agree to these Terms and Conditions and our Privacy Policy, then you may not access this website or use any of its services.

SECTION 2 – PERMISSIBLE USE OF THIS SITE

This website provides a forum to connect local area employers offering employment and other work placement opportunities (“Employers”) with individuals seeking those opportunities (“Applicants”.) We offer this website free of charge with the express understanding that Grow QC does not serve as a representative of or agent for any Employer or Applicant. We do not verify and are not responsible for any errors, omissions or misrepresentations in the job listings, user profiles or personal information. All users are advised to independently verify the accuracy and legality of any information before relying on it.

We are further, not responsible for the conduct of any Employer or Applicant accessing or using this site. We are not responsible for any unauthorized access, use or disclosure of personal information by Employers or Applicants. Users are responsible for ensuring the security and confidentiality of their personal information. All submissions and use of information is strictly at your own risk.


Employer Accounts. If you are an Employer, you are permitted to use this site to post employment and other work placement opportunities and to obtain information from Applicants for use in lawful hiring or human resource activities. You are solely responsible for and must ensure that the content you submit to this site is accurate, up-to-date, non-discriminatory and complies with all applicable laws, including wage and hour, anti-discrimination and data privacy laws. You are further responsible for taking all steps necessary to comply with the Data Protection Terms below governing your use of Applicants’ Personal Information made available to you through this site.

Employer accounts are for business use and not for personal use and Employers are responsible for all activity occurring on or through the Employer’s account.


Applicant Accounts. If you are an Applicant, you are permitted to use this site and its content for your personal, non-commercial purposes of seeking employment or other workplace opportunities. By submitting any information to us through this Site, including but not limited to your Personal Information, you represent and warrant that you are at least 18 years of age or, if between the ages of 13 and 18, have submitted a complete and valid Consent Form permitting your use of this site. You further authorize us to disclose your information to Employers as described in these Terms and Conditions and to use your information in an aggregate, non-personally identifying manner to improve our services and for our other business purposes described in our Privacy Policy. However, we do not control Employers or their application processes. You agree and understand that the Employer is responsible for the accuracy of all information posted by the Employer and is solely responsible for any use it makes of your information, including any decision made in the interviewing and hiring process and any use of your Personal Information in violation of these Terms and Conditions.

This site is intended to connect Employers and Applicants for the purposes described above. Employers may choose to contact Applicants directly using the Personal Information supplied through this site. Any communications and information exchanged between Employers and Applicants outside of this site is strictly at the discretion and responsibility of those persons.


SECTION 3 – REGISTERING AN ACCOUNT

To access the resources available on this site, you may be asked to provide registration details or other information. It is a condition of your use of this site that all information you provide is correct, current and complete. When you create an Applicant account, you represent and warrant that the Personal Information supplied to create the account belongs to you or is submitted with the consent of the identified person. When you create an Employer account, you represent and warrant that you are authorized by the Employer to create the account and to use this site on its behalf. Employer accounts belong to the Employer and you acknowledge that all information you provide through the account will be visible to the Employer.

We may contact you by email, phone, postal mail, text message or other electronic method using the information associated with your account. By providing a phone number, you confirm you are the primary user and agree to receive calls and text messages at that number. You may choose your preferred method of contact or withdraw your consent by adjusting your account settings or contacting us at: quadcitieschamber@quadcitieschamber.com.

If you choose or are provided with a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential. Each Employer and Applicant is responsible for the security and confidentiality of account login credentials. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security of your account.

We have the right to disable any username, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms and Conditions.


SECTION 4 – DATA PROTECTION TERMS

Through use of this Site, Employers will gain access to the Personal Information of Applicants for the limited purpose of contacting Applicants for legitimate and lawful employment and workplace opportunities (the “Permitted Use”). Employer may only process, retain, use or disclose Personal Information to the extent and in the manner necessary for the Permitted Use and in accordance with applicable law and any written instructions provided by the Applicant. Employer may not process, retain, use or disclose the Personal Information for any other purpose. Employer will maintain the confidentiality of all Personal Information and may not sell, share or otherwise disseminate the Personal Information to any third party, including, without limitation, for any cross-context behavioral (targeted) advertising. The Employer may transfer the Personal Information to any subprocessor only if a written contract requires the subprocessor to maintain the confidentiality and security of Personal Information in a manner consistent with these Data Protection Terms. Employer may not transfer or store any Personal Information outside the United States.

Employers must always implement appropriate technical and organizational measures designed to safeguard Personal Information against unauthorized or unlawful processing, access, copying, modification, storage, reproduction, display or distribution and against accidental loss, destruction, unavailability or damage. Employer will limit Personal Information access to those employees who require Personal Information for the Permitted Use and have agreed to take necessary precautions to protect the Personal Information. Employer will promptly notify the Grow QC if Employer’s account on this site has been compromised or otherwise accessed without authorization.

Employer will promptly notify any Applicant whose Personal Information may have been compromised or otherwise accessed without authorization. Employer must promptly comply with any Applicant request or instruction requiring the Employer to amend, transfer, correct or delete the Applicant’s Personal Information or to stop, mitigate or remedy any unauthorized processing. Employer must cooperate with and assist Grow QC to timely respond to any complaint, notice, communication or other request made by an Applicant concerning Applicant’s Personal Information.

Upon the termination of Employer’s user account for any reason, Employer will securely destroy all Personal Information made available to Employer through the use of this Site.


SECTION 5 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site.

Third-party links on this site, including those provided by Employers, may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites or for any other materials, products or services of third parties.


SECTION 7 – PROHIBITED USES OF THIS SITE

You may use this site only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the site:

  1. In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data to and from the US or other countries).
  2. For the purpose of exploiting, harming or attempting to exploit or harm minors.
  3. To send, knowingly receive, upload, download, use or re-use any material that does not comply with the content standards set out in these Terms and Conditions.
  4. To transmit or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  5. To impersonate or attempt to impersonate Grow QC, its employees, another user or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).
  6. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the site or which, as determined by us, may harm users of the site or expose them or us to liability.

Additionally, you agree not to:

  1. Use any robot, spider, artificial intelligence tool or other automatic device, process or means to access the site for any purpose, including monitoring or copying any of the material on the site.
  2. Use any manual process to monitor or copy any of the material on the site for any other purpose not expressly authorized in these Terms and Conditions.
  3. Use any device, software or routine that interferes with the proper working of the site.
  4. Introduce any viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.

Information and content you submit using this site, including through any Employer posts or listings, must not:

  1. Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable.
  2. Promote sexually explicit or pornographic material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  3. Infringe any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person.
  4. Violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms and Conditions and our Privacy Policy.
  5. Be likely to deceive any person, including through the use of any false name or contact information.
  6. Promote any illegal activity or advocate, promote or assist any unlawful act.
  7. Cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person.
  8. Impersonate any person or misrepresent your identity or affiliation with any person or organization.
  9. Involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising.
  10. Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions.

This site and its entire contents, features and functionality are owned by Grow QC, its licensors or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

These Terms and Conditions permit you to use this site for limited purposes. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our site for any other purpose except with our prior written consent. We do not guarantee that any contact or communication initiated through the site will be delivered, received or acted upon or that Applicants will receive a response or an interview by any Employer. We do not warrant the accuracy of any information submitted by Employers, Applicants or others using this site. You expressly agree that your use of or inability to use, the site is at your sole risk.

We do not guarantee the identity of any employer; individuals claiming to work for employers or applicants and therefore caution users to take appropriate measures for protecting their own health and safety when participating in any communications or job interviews. All users assume all risks associated with interactions or transactions resulting from the use of the website.

In no case shall Grow QC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of this site or any information obtained from or through this site, including, but not limited to, any errors or omissions in any content or any loss or damage of any kind incurred as a result of the use of the site or any content posted. You agree to indemnify, defend and hold Grow QC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any and against any loss, liability, damage, settlement, cost, expense (including reasonable attorneys’ fees), claim or demand due to or arising out of (a) your use of this site or any information made available from or through this site; (b) your breach of these Terms and Conditions or violation of law; (c) your misrepresentation or other wrongful conduct; or (d) any security breach affecting Personal Information in the possession or control of Employer.


SECTION 11 - SEVERABILITY

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed to be severed from these Terms and Conditions; such determination shall not affect the validity and enforceability of any other remaining provisions.


SECTION 12 – TERMINATION; WAIVER

You may cease using our site and/or terminate your Employer or Applicant account at any time. We have the right to:

  1. Remove or refuse to post any content for any or no reason in our sole discretion.
  2. Take any action with respect to any content we deem necessary or appropriate in our sole discretion, including if we believe that such content violates these Terms and Conditions, infringes any intellectual property right or other right of any person or entity or threatens the personal safety of users of the site or the public.
  3. Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  4. Take appropriate legal action, including, without limitation, referral to law enforcement, for any illegal or unauthorized use of the site.
  5. Terminate or suspend your access to all or part of the site for any or no reason, including without limitation any violation of these Terms and Conditions.

Without limiting the foregoing, we have the right to cooperate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through the site. You waive and hold us harmless from any claims resulting from any action taken by us during or taken as a consequence of a court order or investigations by law enforcement authorities.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms and Conditions for all purposes. The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.

SECTION 14 - GOVERNING LAW AND JURISDICTION

All matters relating to this site and these Terms and Conditions and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Iowa. Any legal suit, action or proceeding arising out of or related to, these Terms and Conditions or the site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Iowa, in each case located in Davenport, Scott County, Iowa, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms and Conditions in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

The owner of this site is based in the State of Iowa in the United States. We provide this site for use only by persons located in the State of Iowa or the State of Illinois, United States.
